Artist Submission and Sale Agreement

PostY2k, operated by Axel Loarca

Summary in plain words
  • PostY2k is a pass-through gallery. We connect you with buyers; we never buy, own or hold your work.
  • You keep your copyright. Buyers get a personal-use digital file, nothing more.
  • On each sale, PostY2k keeps a 15% commission, and a 3.5% transaction fee applies. Both are taken from the sale price. Example: on a $100.00 digital print, the commission is $15.00 and the transaction fee is $3.50, so you receive $81.50.
  • There are no other charges: no submission, hanging or listing fees.
  • You're paid 14 days after the show ends, with a sales report.
  • Admission ticket money belongs to the gallery. Merch, if you sell it, is entirely yours to run.
  • You can withdraw your work with notice. Sales already made still stand.

1. Who we are and what we do

PostY2k is an online gallery operated by Axel Loarca. PostY2k is a pass-through gallery: it shows your work and connects you with buyers. PostY2k does not buy your work, does not own it and does not hold any inventory of it. Each sale is a sale of your work to the buyer, arranged through the gallery.

2. Your promises about the work

By submitting, you confirm that:

  • each piece is original and was made by you, or you otherwise own all the rights needed to show and sell it;
  • it does not copy or infringe anyone else's copyright, trademark, privacy or other rights;
  • if you used any AI or software tools to make it, you have told us which ones, and their output is yours to sell under those tools' terms;
  • the information you give us about the work (title, medium, size, year, edition) is accurate.

3. Copyright and credit

You keep full ownership of your work and its copyright. Nothing in this agreement transfers it. Wherever the gallery shows or promotes your work, it will credit you by your name and artist handle.

4. Permission for PostY2k to show your work

You give PostY2k a non-exclusive permission to display your submitted work online in the gallery, and to use images of it, your name, your handle and your bio to promote the show and the gallery (on the website, in social posts, in press and in the show's archive). Non-exclusive means you can still show, sell and license your work anywhere else. You can end this permission by removing your work (section 13); after removal we stop new uses, but copies already sold, and promotion already published, can stay.

5. What buyers get

Pieces are sold as digital files (digital prints delivered by download). The buyer gets a personal, non-commercial license to view, display and print the file for themselves. The buyer does not get the copyright and may not resell the file, reproduce it for sale, share it for others to download, or use it commercially. You keep the copyright.

6. Prices

You set the asking price for your work. The final listed price is agreed with the gallery before it goes on sale, and the gallery won't change a published price without checking with you.

7. Editions and limited runs

If you set an edition size or limited run for a piece, the gallery will show it and stop selling that piece once the edition sells out. Don't sell the same edition elsewhere in a way that breaks the limit you set.

8. Commission, fees and no other charges

For each sale:

  • PostY2k keeps a commission of 15% of the sale price;
  • a transaction fee of 3.5% of the sale price applies to all digital sales (it covers payment processing and delivery);
  • both are calculated on the full (gross) sale price, before anything else is taken out.

Worked example: on a $100.00 digital print, the commission is $15.00 and the transaction fee is $3.50, so you receive $81.50.

There are no other charges for any items sold: no submission fees, no hanging fees and no listing fees.

9. Payouts and sales reports

Your earnings are released 14 days after the show ends, together with a sales report showing your purchase volume and other sales figures. To be paid, you'll need to give us a payout method (for example a bank transfer or a payment account) and the details it requires, such as your legal name and payout account details. If we can't pay you because details are missing, we'll hold your earnings until you send them.

10. Refunds, chargebacks and fraud

Digital sales are generally final. Buyers do not download any files. The only downloadable file is the catalog for each show, which is available for every show. PostY2k refunds a digital sale only when the purchase was not delivered as described or is defective, and then fixes or refunds it. If a sale of your work is refunded, charged back or found to be fraudulent, that amount is taken out of your payout (or out of a later payout if it was already paid).

11. Merch

If you list merch (physical products) in a show, you are fully responsible for it: production, sale, shipping and distribution, returns, refunds and customer service. PostY2k only provides the listing or the connection to buyers.

12. Admission

Visitor admission prices are set by PostY2k. Admission money belongs to the gallery, not to the artists, unless a particular show says otherwise in writing.

13. Withdrawing your work

You can withdraw a piece from sale or from the gallery at any time, before or during a show, by emailing us. We'll take it down within 7 days of your notice. Sales completed before removal are honored, and those buyers keep their license.

14. Content rules and the gallery's choices

Don't submit work that is stolen or copied, hateful or harassing, or illegal. Explicit or graphic work must be clearly labeled when you submit it. The gallery chooses what to show, and may decline a submission, or remove work that breaks these rules, at any time.

15. We won't misuse your files

PostY2k will not sell, license or give away your original files, and will not use your work or files to train AI models, or allow anyone else to. Your files are used only to run the gallery, deliver purchases and promote your work as described above.

16. Taxes

Each party is responsible for its own taxes. You're responsible for tax on your earnings. If the law requires it, you'll give us the tax forms or information we need to pay you.

17. Privacy

We use your personal information (name, email, answers, payout details) only to run the show, pay you and contact you about your work. We don't sell it.

18. Responsibility and claims

PostY2k runs the gallery with reasonable care, but it can't promise that the website will always be available or that any piece will sell. To the extent the law allows, PostY2k's total responsibility to you under this agreement is limited to the amount it owes you in unpaid earnings. If someone makes a claim that your work infringes their rights, you agree to cover the gallery's reasonable costs of that claim.

19. Changes to this agreement

PostY2k may update this agreement. Each version is numbered. We'll give you notice by email before a new version applies to your work, and you can withdraw your work if you don't agree with it.

20. Governing law

This agreement is governed by the laws of the State of Rhode Island.

21. Electronic signature

By ticking the box and typing your full name below, you sign this agreement electronically, and that has the same effect as a handwritten signature.
